You're not making the right distinctions. Are we talking about legal obligations or moral obligations? Are we talking about public employers or private employers? Are we talking about strong affirmative action required by the courts or action undertaken voluntarily?
Private employers should not be required to compensate blacks for discrimination prior to the 1964 Civil Rights act because they acted within their moral and legal rights.
Discrimination since the 1964 law went into effect is illegal, but my own view is that Title VII of the 1964 Civil Rights Act is unjust to private employers and should be repealed.
