You may be right if we take a narrow view of the Constitution. But we should ask ourselves whether we serve the nation best by limiting our interpretation to the intentions or the meaning of the people who drafted or supported this amendment.

I think Sunstein is on to something. Of course the amendment doesn't refer to income or health care. It addresses the problem of inequality as it was manifested at that time. But we have to address inequality as it is manifested today. The law is a living thing that has to be adjusted to changing curcumstances.
