We don't have to go back to the moral equivalent of a pernicious tendency test. I agree with you that some speech that causes harm should be protected.

But we may be faced here with a situation in which the harm done is the violation of another right. I would suggest that people have equality rights and that when speech is used to violate those rights, we are justified in restricting it. This is a very special case of harm. It does not open the floodgates for wholesale restriction.
