I think you have to distinguish between different kinds of discrimination based on race.
At one time state and federal governments discriminated in a way that harmed blacks. That discrimination was intended to subordinate blacks and provide them with inferior services. The discrimination we are talking about today is designed to help blacks rise economically and politically.
The first kind of discrimination is harmful, but the second kind is benign. The first should be illegal, but the second should not.
