I'm not saying that every black job applicant should be chosen over every white applicant. Nobody believes that.

In the first place, anyone chosen for a job should be able to do the job adequately. That's one limitation right there.

In the second place, we might look at the criteria used by the Supreme Court in the Weber case. The Court said that plans could not ignore the interests of white workers, had to be temporary, and had to apply to traditionally segregated job categories. The Court has also said that tests that are closely related to the job are legitimate hiring devices. These are all limits that protect white employees and white job applicants.
