I don't think you have to worry too much about exceeding fair limits with strong affirmative action programs. The political limits on strong affirmative action are very substantial. There are some well-publicized cases that scare the pants off of white people. But the reality is that there is nowhere near as much affirmative action as they think.

Already there have been cases in which strong programs have been scaled back. The Bakke decision in California restricted the program that Bakke objected to. In other supreme Court cases, like Croson, strong programs have been further limited.
