Maybe I should be a little clearer about what I'm trying to say about discrimination and rights.

My basic position is that racial discrimination is unjust because it treats equal cases unequally. There are no morally relevant differences between blacks and whites. Black people have a right to equal treatment and it is unjust, for example, for employers to treat them differently.

But if you deny that discrimination is a violation of rights, I would still argue that government is justified in restricting the rights of the employer because of the enormous evil that discrimination causes.
