You keep saying that justice requires us to treat equal cases equally. I agree, but it is not clear what that tells us in this case.
If I give my boyfriend a present because I love him, I treat him differently from others. Am I unjust? Of course not. The very fact that I have a certain attitude toward him is a relevant difference. The same applies to employers. If an Italian restaurant owner wants to hire all Italians or if a Black Muslim owner wants to hire all Muslims or if a white owner wants to hire all whites, his attitude is a relevant difference when dealing with his property. If you deny it, then how can it be just for me to treat my boyfriend differently?
