Everyone agrees that the old southern regime of legal segregation and restriction on the basis of race was not only wrong but unjust. But when the federal government wiped out that regime, it went beyond declaring the old laws on race unconstitutional. It opted to outlaw racial discrimination by private employers.
We didn't stop to ask whether laws against discrimination were needed to undo the effects of the old regime. We didn't experiment with a free market solution. What if we made a mistake?
If we did, your debate about which principle of compensation to use is unnecessary. We don't need compensation or anti-discrimination laws.
