One way to argue against this view would be to say that black and white people are basically different, having basically different capacities and tendencies. The differences would justify NOT treating them as equals.

Essentially that is the response of a traditional white racist. But it depends on proving certain empirical claims about differences between blacks and whites. I don't think those claims can be proven because I don't think there are such differences.

I conclude that the governmental discrimination we're talking about was unjust and that we should consider whether compensation is due.
