All of that sounds good, but it doesn't always work that way. In theory an employer is protected by making a good faith effort, but in practice the employer may be worried about the cost of developing "unbiased" tests and all the litigation that can result if someone complains.

The easy solution is to hire by the numbers, meet the goal, and get on with the work at hand. If the employer figures that it's cheaper to treat the goal as a quota rather than end up in court, then that's what he or she is going to do.

The employer and the rejected white applicants pay the price. You may not call that a quota system, but in effect it is.
