I have problems with the notion that the code should apply to black students and white students alike. I know that equal appllication sounds fair, but I don't think it really is fair.

A few minutes ago you mentioned an ancient principle of justice: treat equal cases equally. Now you're assuming that the cases of white students and black students are equal. But you haven't shown that to be true. You haven't even made an argument. You have simply assumed that the cases are equal. My point is that they are not equal because the history of blacks and whites in this country is very different.

Because of that history, names like "nigger" harm black students much more than anything they can call white students. As long as that is true, the cases should not be treated the same.
