I want to make one more point. Americans often assume that extensive freedom of expression makes for the best functioning democracy. How do we know that's true?

If you read some of the critical race theorists, you may come to a different conclusion. Perhaps the freedom of racists to speak discourages political participation by African Americans, suppresses their speech, and excludes their ideas from the political arena. All of that would make America less democratic.

It may be that in most cases free speech promotes democracy but that in some cases it inhibits it. We have to think about that possibility and whether it justifies an exception to the general rule on free expression.
