Equal Treatment

When we're talking about two concrete cases -- say two murderers -- it makes sense to say they should be treated the same unless there are relevant differences. But now we seem to be talking about everyone being treated the same unless there are relevant differences. I'm losing track of the basis of comparison. Everyone should be treated the same AS WHAT? Everyone else? I'm not sure if that tells us anything. Is that what we're suggesting?
