I think that
creating positive rights put us on a very slippery slope, both logically and empirically.
Logically, it is hard to provide a justification for a few positive rights that cannot be extended to many more
positive rights. There is no way to limit the rationale. The list will grow and grow. If there is a positive right to health care, why not
basic education? If there is a positive right to basic education, why not a college education? If there is a positive right to shelter, why not a nice house and a car? Logically, there is no reason
to stop.
Empirically, something parallel will occur. Once the political forces that support one positive right are in place, they will be expanded. More positive rights will be offered to the electorate. Politicians will compete to offer the best deal. There's no end to it.
