The philosopher Thomas Nagel believes that not all rights have the same gravity or weight.

There may be a top tier such as the right not to be killed. There may be lower tiers such as the right to determine the use of one's property.

In some cases, the achievement of some great good may justify violating a right (perhaps a lower tier right). This does not mean that the right can be justly violated whenever it would achieve some good or even maximize some good. It isn't necessarily the same as utilitarianism.

Nozick seems to believe that his property entitlements are at the top of the rights hierarchy. Buy why? Isn't is counterintuitive to put them above saving lives for example?
