There is no way for job applicants to know whether they are being discriminated against unless we use overall statistics as a flag.
The courts have said that there is at least the appearance of discrimination when there is a manifest imbalance between the number of blacks in the labor force who are qualified to do a certain kind of work and the number hired by a particular employer. But if someone brings a charge against an employer on those grounds, the employer then has an opportunity to prove that the hiring tests they use are closely related to the job and to their own business needs. Given our history of discrimination, why is that so unfair?
