Bringing in beneficiaries is a step in the wrong direction. If you try to apply the new principle you will run into all sorts of problems.

For one thing, how do we know that the white job applicant benefited significantly from racial discrimination? What if he is a recent immigrant? What if he lives in an area where there are very few blacks?

And here's another problem. Have you thought about the black businessmen and professionals who benefited from segregation and discrimination? Racial segregation supplied them with a guaranteed market for their services. Are you going to make them pay compensation to other blacks?
