Traditionally, employers have been able to hire as they wish. I think the idea that job applicants have a RIGHT to be hired on the basis of job related qualifications is groundless. Think of what it implies:

It means that when someone hires their cousin or a friend or a veteran or a handicapped person who isn't the very best candidate, they violate someone else's rights. It means that if a company promotes from within to keep up morale, they violate someone's rights.

It means that if a company is looking for a new chief executive and I am best able to do the job, then I have a RIGHT to be brought in to run the company. Does anyone really believe that?
