We've talked about WHO should receive compensation, WHY they should receive it, and WHO should bear the burden. But what about the FORM that compensation should take?
All four of our principles of compensation tell us that the purpose of compensation is to put people in the condition they would in today if fair play had been the rule. In theory, that ought to guide us in deciding what sort of compensation is appropriate in particular cases. But I'm not sure whether it does, especially with the more liberal principles of compensation.
