The same thing is true with schools. Academic qualifications are not the only thing schools consider. Some universities give preference to the children of their graduates. Or they may give preference to students from certain areas of the country. Lots of them take in athletes who couldn't otherwise qualify. State schools often make it easier for state residents to get in. Medical schools often prefer younger applicants.

There are reasons for all of these policies. State residents are more likely to remain in the state after graduation. Athletes bring in revenue. Alumni donate money. Younger doctors provide more years of service. The point is that schools often consider more than academic merit, and we don't usually consider this a violation of anyone's rights.
