But questions about rights are relevant up front if we are concerned with compensation.
If you are comparing employment discrimination against blacks to theft, then you are suggesting that it violated their rights. Indeed, injustice is usually thought of as a violation of someone's rights; and compensation is owed exactly because rights were violated.
If private discrimination didn't violate the rights of black people, then at least that particular basis for compensation collapses.
