English may have described how we use the term 'person' in everyday
life. But keep in mind that it is possible to prove that the embryo
or fetus is not a person by discovering just one necessary element
of personhood that it lacks. That is the strength of the arguments
made by Warren and Tooley.
(Tooley is not much concerned with the ordinary use of the word 'person.' He uses the word in a purely technical sense to mean a being that has a serious right to life. Thus his question is really about the necessary conditions for having rights.)
