Many critics deny that a woman's right of privacy includes the right to abort because they deny that she is the only party involved. If the fetus is a person or has serious rights, then her decision is not one that significantly affects only herself.

The state of Texas argued that the fetus was both a legal and a natural person throughout pregnancy. Blackmun replied that none of the references to people in the Constitution referred to unborn children. He further claimed that if experts disagree, the Court could not decide "when life begins." He did not say why. Nor did he say why state legislatures could not make a choice between competing views on this issue.
